We recovered £175,000 in a product liability claim for a faulty hip
replacment that had to be revised as it caused severe back
pain.
Samantha Critchley acted in
the claim that arose out of early failure of a total hip
replacement in June 1992, revised in 1996.
After investigation and negotiation, liability was apportioned
equally between the defendants. The evidence was that the need
for a revision hip was brought forward by 10 years.
The shortening Miriam's hip resulted in back pain which meant
that the claimant had to give up work. Miriam also suffered a
psychiatric injury. Causation and quantum were hotly
disputed.
The case settled in the sum of £175,000 which was at the highest
end of the range of settlements achieved in the 3M litigation
cases.
