Charity shop manager awarded £80,000 in breast cancer claim

Jackie was found to be suffering from breast cancer. She initially underwent radical right mastectomy and then had chemotherapy and radiotherapy.

Although further treatment by way of tamoxifen was considered, the hospital failed to measure Jackie’s oestrogen receptor status.

The failure to do so was negligent and as a result this cancer remained untreated for some 2 years and 8 months leading to a left mastectomy and choroidal metastases affecting the sight in her right eye.

Jackie underwent further chemotherapy developing polyarthropathy as a result causing painful symptoms in her back, hips, arms and hands. She has responded well to Tamoxifen and is now in remission but remains disabled and unable to return to her job as a manager of a charity shop.

Although the hospital admitted negligence they argued that the events and damage to Jackie would have amounted the very much the same notwithstanding the failure to provide Tamoxifen earlier.

Damages were recovered in the sum of £80,000.
