Damages for perforated bowel during keyhole surgery

Richard Earle recovered compensation for Martha who suffered damages when her bowel was perforated during keyhole surgery at the QEII Hospital, Welwyn Garden City in March 2008.

Martha, who was 43 at the time, was told that this was a straightforward procedure to remove her gallbladder when it was discovered that she had gallstoens. She was told she would be back to work within a fortnight.

Her gallbladder was removed but her bowel was perforated during the surgery.

Unfortunately this was not picked up immediately and Martha endured a considerable amount of pain and discomfort. ACT scan revealed the performation and she underwent an emergency repair.

Thereafter she suffered persistent problems in terms of wound infection. Her condition became life threatening. She required nursing in the ICU.

She complained to the hospital about the events.

Following several months off work Martha continued to suffer from abdominal pain as well as depression for which she was referred for counselling.

Martha developed a hernia and required further surgery. She did not return to work until March 2009.

Martha instructed Richard Earle to pursue a medical negligence claim against the hospital. Following investigations Richard entered into negotations with the defendant solicitors.

After discussions, the claim was settled for £25,000.
