“Trigger Issue” Win for Mesothelioma Claimants

Today in the High Court in London Mr Justice Burton gave Judgment in the “trigger issue” cases.

The cases involved claims brought by people suffering from asbestos diseases, including the asbestos cancer of mesothelioma.

Insurance companies had argued that the asbestos victims were not entitled to compensation under the terms of their insurance policy.  The effects of this would have been to leave victims and their families uncompensated.  It would have saved insurance companies millions of pounds. 

In his Judgment Mr Justice Burton found for the asbestos claimants who are therefore now entitled to compensation.

Rodney Nelson-Jones, Head of the asbestos claims department of Field Fisher Waterhouse, said
