Claims Department, chaired a meeting of the Occupational Health
Group of the Association of Personal Injury Lawyers
(APIL), gathering together approaching 100 of the country's top
asbestos lawyers in London to hear talks from the Senior Master of
the Royal Courts of Justice, Master Whitaker, on procedure in
asbestos disease claims and from Frank
Burton QC on the legal implications of the House of Lords' decision
in the Pleural Plaques Test Cases. In that case the Lords brought
to an end the right of those suffering from asbestos-related
pleural plaques to recover compensation from their negligent
employers. The judgment threatens thousands of asbestos disease claims and stands to give the
insurance industry a huge windfall.
Andrew Morgan said "We had a lively discussion as to the ways in
which the effects of this unwelcome decision can be overcome, one
way or another. We are exploring various possibilities that were
identified at the meeting. It would be premature for the insurance
industry to congratulate itself just yet."
Peter Williams, Partner in the
Asbestos Claims Department, recovered
£26,000 for his client, Mr Hindson, in the Pleural Plaques Test
Cases. Mr Hindson was the only Claimant to
obtain any compensation.
